Child Welfare and Attendance (CWA) has been designated by San Bernardino County Board of Education to process appeals regarding expulsions and interdistrict attendance transfers. All appeals must be filed within thirty (30) calendar days from the date of the school district’s written final decision on a case. Forms mailed and postmarked but not actually received by the CWA office during the normal business hours of 7:30 a.m. – 4:30 p.m. and within the 30 calendar days will not be accepted. Final decisions on all matters that cannot be informally resolved through the CWA office can only be rendered by the County Board of Education.

Expulsion Appeals

An expulsion is an action by a student’s district of residence to remove a child from school and to limit the types of schools the child may attend. If a pupil is expelled from school, California Education Code 48919 provides 30 days from the local governing board’s decision for a pupil or a pupil’s parent or guardian to file an expulsion appeal with the County Board of Education. An appeal must be filed within 30 calendar days. Detailed information regarding the expulsion appeal process can be obtained by reading Board Policy 141.

Interdistrict Attendance Appeals

California Education Code 48200 provides that a pupil shall attend school in the district in which the parent or legal guardian resides, unless otherwise exempted. A parent whose request for his/her child to attend school outside of the district of residence has been denied may appeal to the San Bernardino County Board of Education. An appeal may be submitted whether the permit request was denied by the district of residence or by the district of desired attendance.
