SANDABS Bylaws


Article I - NameThe name of this organization shall be San Bernardino County District Advocates for Better Schools (SANDABS). Article II - PurposeThe purpose of this organization is the promotion and advancement of public education through legislation in the State of California, and cooperation with associations and persons whose interests and purposes are for quality education of the children in the State. Article III - Membership

Section 1.

All school districts; the West End, East Valley, and Desert/Mountain Special Education Local Plan Areas; the Colton-Redlands-Yucaipa and Baldy View Regional Occupational Programs; and the San Bernardino County Superintendent of Schools are eligible for membership in SANDABS.

Section 2.

Each school district, special education local plan area, regional occupational program, and the County Superintendent of Schools shall pay an annual membership fee as established by the Executive Committee. The fees shall be paid by transfer from the general fund of the district, or by warrant, to the San Bernardino County Superintendent of Schools on or before October 1 of each year.

  Article IV - Executive Committee: Superintendents

Section 1.

Superintendents on the Executive Committee shall be represented by nine school district superintendents and the San Bernardino County Superintendent of Schools, or his designee.

Three superintendents shall be appointed from each of the three regions of San Bernardino County, provided that their respective districts are members in good standing with SANDABS.

  • East Valley - Colton Joint Unified, Fontana Unified, Redlands Unified, Rialto Unified, Rim of the World Unified, San Bernardino City Unified, Yucaipa-Calimesa Joint Unified, Colton-Redlands-Yucaipa ROP, and East Valley SELPA.
  • West End - Alta Loma, Central, Chaffey Joint Union High, Chino Valley Unified, Cucamonga, Etiwanda, Mountain View, Mt. Baldy Joint, Ontario-Montclair, Upland Unified, Baldy View ROP, and West End SELPA.
  • Desert/Mountain - Adelanto, Apple Valley Unified, Baker Valley Unified, Barstow Unified, Bear Valley Unified, Helendale, Hesperia Unified, Lucerne Valley Unified, Morongo Unified, Needles Unified, Oro Grande, Silver Valley Unified, Snowline Joint Unified, Trona Joint Unified, Victor, Victor Valley Union High, and Desert/Mountain SELPA.

Section 2.

Appointments to the Executive Committee shall be made at the November meeting of district superintendents.

Section 3.

The term of office for superintendents on the Executive Committee shall be two years, and may not exceed two consecutive terms unless agreed to by the superintendents from the appropriate region. Terms of office shall be staggered as follows:

  • Expires in 1990 and every even-numbered year thereafter: Two superintendents from each of the three regions.
  • Expires in 1991 and every odd-numbered year thereafter: One superintendent from each of the three regions.

Section 4.

Superintendent vacancies on the Executive Committee shall be filled by appointment as recommended by superintendent members of the Executive Committee.

Section 5.

Any superintendent who fails to attend three consecutive regular meetings without adequate cause may be removed from office by a majority vote of the Executive Committee.

  Article V - Executive Committee: Trustees

Section 1.

Trustees on the Executive Committee shall be represented by nine trustees from school districts of San Bernardino County.

Section 2.

The President, CSBA Director of Region 16B, and the Legislative Chair of the San Bernardino County School Boards' Association (SBCSBA) shall serve as members of the SANDABS Executive Committee, provided that their respective districts are members in good standing with SANDABS. The term of office for these representatives shall be for two years to coincide with their term on the SBCSBA Executive Committee. The President, CSBA Director of Region 16B, and the Legislative Chair shall be considered at-large trustee representatives to SANDABS.

Section 3.

The SBCSBA President may appoint an alternate trustee to serve on the SANDABS Executive Committee. The alternate must represent a school district that is a member in good standing with SANDABS.

Section 4.

There shall be two (2) trustees elected from each of the three (3) SANDABS regions of San Bernardino County. County Board of Education members shall be eligible for election to SANDABS in the region that includes most of the school districts of a given trustee area.

  • East Valley - Colton Joint Unified, Fontana Unified, Redlands Unified, Rialto Unified, Rim of the World Unified, San Bernardino City Unified, Yucaipa-Calimesa Joint Unified, and Trustee Areas C, D or E of the County Board of Education.
  • West End - Alta Loma, Central, Chaffey Joint Union High, Chino Valley Unified, Cucamonga, Etiwanda, Mountain View, Mt. Baldy Joint, Ontario-Montclair, Upland Unified, and Trustee Area B of the County Board of Education.
  • Desert/Mountain - Adelanto, Apple Valley Unified, Baker Valley Unified, Barstow Unified, Bear Valley Unified, Helendale, Hesperia Unified, Lucerne Valley Unified, Morongo Unified, Needles Unified, Oro Grande, Silver Valley Unified, Snowline Joint Unified, Trona Joint Unified, Victor, Victor Valley Union High, and Trustee Area A of the County Board of Education.

Section 5.

In the fall of each year the SBCSBA Executive Committee shall review trustee representation on the SANDABS Executive Committee to determine the election to be held pursuant to that review.

Section 6.

The election shall be conducted as follows:

  1. The SBCSBA President, on behalf of the SBCSBA Nominating Committee, shall send letters to appropriate governing boards inviting trustees to suggest names for nomination to the SANDABS Executive Committee.
  2. The Nominating Committee shall present a slate of candidates for SANDABS trustee representatives at the January annual meeting in a manner similar to candidates for officer and area director elections. Additional nominations from the floor shall be permitted.
  3. At the January annual meeting in the odd-numbered years, one trustee representative from each SANDABS region shall be elected by ballot to serve a term of two years or until their successors are selected. Likewise, in even-numbered years, the second trustee representative from each SANDABS region shall be elected by ballot to serve a term of two years or until their successors are selected.
  4. SANDABS trustee representatives shall assume their duties at the close of the annual meeting at which they are elected.
  5. No SANDABS trustee representative shall hold more than one office at a time, and no member shall be eligible to serve more than two consecutive terms in the same office.
  6. In the event that a SANDABS trustee representative is unable to complete his or her term of office, the SBCSBA President, subject to ratification of the SBCSBA Executive Committee, shall appoint a replacement to complete the term of office. The appointee shall be from a district that is a member in good standing with SANDABS and shall be from the region in which the vacancy occurs.

Section 7.

Any trustee who fails to attend three consecutive regular meetings without adequate cause may be removed from office by a majority vote of the Executive Committee.

  Article VI - Officers

Section 1.

The Executive Committee shall elect officers at the first regular meeting held in February.

Section 2.

Two co-chairs shall be elected, one superintendent and one trustee, who shall alternately preside at all meetings of the Executive Committee.

Section 3.

Two vice chairs shall be elected, one superintendent and one trustee, who shall preside at the appropriate meeting in the absence of the respective co-chair.

  Article VII - Responsibilities of the Executive Committee

Section 1.

he Executive Committee shall represent SANDABS in legislative and policy issues affecting public education. This representation may include, but is not limited to: adopt positions relative to proposed legislation, provide testimony at committee hearings, conduct meetings with legislators and/or staff, provide input or background data for proposed legislation, respond to inquiries.

Section 2.

The Executive Committee shall conduct regular meetings on the second Wednesday of each month at 3:00 p.m. in conference rooms located at the Roy C Hill Education Center, 601 North E Street, San Bernardino. Regular meeting dates may be changed with a majority vote of the Executive Committee. Special meetings may be called by one or both co-chairs.

Section 3.

A simple majority of the total membership shall constitute a quorum at Executive Committee meetings.

  Article VIII - Standing Committees

Section 1.

Special committees may be formed as necessary to track specific legislation affecting planks of the SANDABS platform, or other issues which may arise throughout the legislative session. Responsibilities of the special committees shall include, but not be limited to: recommend adoption of positions by the Executive Committee, respond to correspondence, prepare alternative solutions or backup data for use by legislators or staff, provide testimony at committee hearing. Special committees may also be formed to develop the legislative platform, propose Bylaws amendments, or other policy issues as determined by the Executive Committee.

Section 2.

The following definitions shall be used by the special committees and the Executive Committee when adopting positions on specific legislation:

  • Support: Actively advocate for passage of the measure.

  • Approve: Send letter in support of measure.

  • Watch: No position, but track measure for significant amendments.

  • Disapprove: Send letter in opposition of measure.

  • Oppose: Actively advocate for defeat of the measure.

  • "And Amend" may be applied to any of the above positions, indicating that the position is not contingent on amendments.

  • "If Amended" may be applied to support or approve positions, indicating that support or approval is contingent on amendments.

  • "Unless Amended" may be applied to oppose or disapprove positions, indicating that position will shift to watch if amendments are adopted.

A support or oppose position may involve, but is not limited to:

a. send letter in support or opposition of the measure;

b. initiate telephone tree to seek contact by superintendents and trustees with area legislators;

c. contact author of measure and propose alternatives, if appropriate;

d. prepare detailed, backup information to support SANDABS' position;

e. request assistance from advocate in Sacramento;

f. contact consultants to appropriate committees; and

g. offer testimony at committee hearings.

  Article IX - Travel Expenses

Section 1.

Approved actual and necessary travel expenses shall be reimbursed.

Section 2.

Breakfast, lunch and/or dinner expenses for Executive Committee members, staff, and invited guests shall be paid from the budget for meetings held during meal times.

  Article X - Role of County Superintendent

Section 1.

The San Bernardino County Superintendent of Schools shall designate staff in the Legislation Office to support and facilitate the activities of SANDABS. These duties shall include, but not be limited to: preparation and distribution of meeting notices and appropriate backup materials, agendas, minutes, and correspondence.

Section 2.

The County Superintendent shall provide meeting facilities in the Roy C Hill Education Center for the Executive Committee and special committees as appropriate.

  Article XI - Legislative Advocate

Section 1.

The Executive Committee shall financially support legislative advocacy services through a contract between San Bernardino County District Advocates for Better Schools and a legislative advocate in Sacramento.

Section 2.

CoContact with the legislative advocate in Sacramento shall be made only through the Legislative Analyst of the County Superintendent's Office. At no time shall direct contact be made by any member of the Executive Committee unless previously arranged by the Legislative Analyst.

  Article XII - Amendment of Bylaws

Section 1.

These bylaws shall be amended by a majority vote of the Executive Committee upon recommendation by a special committee formed for the purpose of developing bylaws amendments.
