Licensing Compliance Procedure

When a Child Development staff member makes a site visit and observes that the Child Care provider is out of compliance, the Community Resource Specialist will discuss with the provider the value of being in compliance.

  1. At the time of a site visit, should a licensing violation be observed, the following steps will occur:
    1. Any observed incident of non-compliance will be documented and placed in the providers file or provider update form.
    2. The Resource and Referral, Child Care Food Program and any applicable Subsidized Child Development program staff will be informed of this action.
    3. A follow-up letter from the Child Development Services Assistant Manager will be sent to the provider. The letter will advise the Provider of his/her responsibility to follow the rules and regulations that govern the Resource and Referral, Child Care Food Program, and any applicable Subsidized Child Development Program. (Including conformity with Title 22 regulations.)
  1. At the time of a licensing violation, if the Provider is enrolled on the Child Care Food Program, the following steps will occur:
    1. The provider will be advised that any meal served during that visit will not be allowed and no reimbursement will be paid.
    2. When Child Development Services receives a claim for reimbursement and the attendance sheets indicate that the Family Child Care provider was over-capacity during any meal service, that entire meal will be disallowed.
  2. The letter will also advise the provider of the Child Development staff's role as a mandated reporter and that on any subsequent visits should there be a violation of the licensing regulations, a report will be given to the Department of Social Services, Community Care Licensing Division.
  3. In the event that another infraction of the licensing regulations occurs, the Provider will be terminated from the Resource & Referral, Child Care Food Program, and any applicable Subsidized Child Development programs.
